Evidence 1 - Bullets: March 18, 2006, Police fired four shots rapidly at Andrew Osidacz's center mass from the hallway outside the bathroom. Two of the four bullets hit right on target, penetrating his chest slightly right of center and lodging in his body at points lower than the entry wounds. The other two bullets were HIGH-off-target grazing his neck (about 6-10" too high). These two bullets blasted holes in the tub surround just 7" above the rim of the tub, depositing forward blood spatter around the holes. Photos of this were exhibited at the inquest. Evidence 2 - Hostage account: Under oath (though she refused to swear on the bible) the alleged hostage demonstrated how Andrew held her tight with his left arm while reaching around with his right arm with a knife in his hand in an attempt to slash her throat. Supposedly she was tight in front and to Andrew's left and Andrew's right arm was across his chest - right where the two entry wounds presented. According to her testimony, after the police fired, she fell with Andrew Osidacz backwards and down into the tub. Evidence 3 Bloody Clothing: Andrew Osidacz's clothing was drenched with blood. However, there was only a small amount of blood on the outside front of the alleged hostage's clothing. This blood residue was determined by lab tests to be a result of "transfer contact." According to the tests, there was no blood spatter anywhere on the "hostage's" clothing. Evidence 4 Upside-down: There were some coins in the bathtub as if contents of a pants pocket fell out - like when the pant leg is held up. A photo of this was exhibited at the inquest. Evidence 5 Jared's cousin's testimony: Jared's cousin testified that the alleged hostage was not in the room when Andrew was shot. He saw her flinch (in the kitchen) when the shots were fired. That testimony could not be impeached under rigorous cross-examination including by the alleged hostage's attorney. THE QUESTIONS... I would want to resolve many questions including: The inquest correctly determined that Andrew was pronounced dead at the Brantford General Hospital. But what was the position of his body when he was struck by the fatal shots? How could two bullets make no wounds on Andrew Osidacz's right arm if, according to the alleged hostage's testimony, his right arm was exactly over the the entry wounds in his chest. If Andrew was holding a hostage so closely when the shots were fired, why did she have no blood spatter on her clothing and why was there so little blood transferred to her clothing and only to the outside front of it? If Andrew Osidacz fell back into the tub, how could coins fall out of his pocket into the tub? Given that the two non-fatal shots hit so close to the floor level, how could Andrew Osidacz have fallen upwards into the bathtub? Is it ok for just one little fact to be twisted? After all, it couldn't hurt anyone. Could it? What if the name on the 2002 assault charge were changed from Craven to Osidacz to avoid a painful truth? Which one is assaulting in this video? What would a video from March 18, 2006 of the police shooting of Andrew Osidacz show? Unfortunately there were no bystanders video-taping like there were for Dziekanski. But there are indesputable forensics. |
The inquest into the deaths of Jared Osidacz and Andrew Osidacz was completed April 1, 2009 and the jury provided their answers and recommendations to the Coroner April 9, 2009. Inquests are prohibited from examining issues to assign legal responsibility or blame.
